Content Creator Agreement
This Content Creator Agreement ("Agreement") is made between SocialCO Media, LLC ("Company") and the undersigned content creator ("Creator"). This Agreement governs the relationship between the Company and the Creator regarding the creation, ownership, and usage of content, including the Creator’s participation and depiction in said content.
By checking the box below, the Creator acknowledges and agrees to the terms set forth in this Agreement:
1. Express Consent
The Creator agrees to enter into this Agreement with SocialCO Media, LLC. The Creator gives explicit consent to be depicted in any content created, posted, or shared on the Company’s platform or other related platforms. The Creator understands that by consenting digitally (e.g., by checking a box during sign-up), they are bound by its terms and conditions.
2. Content Ownership and License
Ownership: The Creator retains ownership of the content they create. However, the Creator grants SocialCO Media, LLC a non-exclusive, worldwide, royalty-free, perpetual license to use, distribute, modify, reproduce, and publicly display the content on its platform and associated services.
Right to Remove Content: SocialCO Media, LLC retains the right to remove or take down any content that violates this Agreement or the Company’s standards, as well as to terminate the Creator’s account in the event of repeated violations.
3. Prohibited Content
The Creator agrees not to create, upload, or share any content that includes:
- Illegal Activities: Any content that promotes, depicts, or facilitates illegal activities, including but not limited to violence, drug use, or criminal behavior.
- Hate Speech or Harassment: Content that promotes hate speech, discrimination, or harassment based on race, gender, sexual orientation, religion, or other protected characteristics.
- Sexually Explicit Content: Any form of pornography or sexually explicit content is strictly prohibited.
- Copyright Infringement: Any content that infringes on the intellectual property rights of others, including the unauthorized use of copyrighted material, logos, or trademarks.
- Child Exploitation: Content that exploits, harms, or otherwise depicts minors in a derogatory or inappropriate manner.
- False Information or Fraud: Content that spreads false or misleading information, scams, or any attempt to defraud others.
- Self-Harm or Harm to Others: Content promoting or encouraging suicide, self-harm, or harm to others.
4. Review and Resolution Process
Upon receiving a complaint, we will acknowledge receipt of the complaint within seven business days. Our dedicated review team will then assess the reported content to determine if it violates our Standards. This review process involves:
- Examining the content in question.
- Evaluating it against our Standards and legal requirements.
- Consulting with relevant parties, if necessary.
- Making a decision about the appropriate next steps.
Please note that the exact process may vary depending on the nature of the complaint.
5. Appeals Process
If you disagree with the outcome of our review, you may submit an appeal by emailing us at socialcomedia@gmail.com. Our appeals team will re-examine the content and the initial decision. We will then provide a final decision within seven business days of the appeal.
6. Outcomes of Investigations/Reviews
The potential outcomes of our investigations or reviews can range from no action, if the content is determined to meet our Standards, to content removal and account termination in serious violations. Please note that legal action may be pursued for violations that involve illegal activity.
7. Consent to Be Depicted
The Creator expressly consents to their participation and depiction in the content created under this Agreement.
8. Governing Law
This Agreement is governed by and interpreted in accordance with the laws of the state of [Insert State], without regard to its conflicts of laws principles.
